Who We Are.

Incident Co., a Delaware corporation (the “Company”) is a company that provides (i) the company website located at www.incidentcode.com, www.incidentco.com, and all associated websites linked thereto (each, a “Site”, and collectively the “Sites”); (ii) a paid subscription services accessible through the Sites (the “Incident Wall”); and (iii) a software that may be downloaded to a smartphone or tablet to access the Company services (the “Mobile App”), all of which are intended to enhance the flow of information  between you, your contact list, and your organization in connection with anything that is out of the ordinary that does not pose an immediate risk of harm, loss of life or other imminent danger to your personal safety. Always call 911 if you need immediate assistance from emergency personnel. Throughout this Privacy Policy, the terms “we”, “us” and/or “our” refer to the Company. The term “user”, “you” or “your” refer to any person or entity who accesses or uses the Services (as defined below).

We are committed to protecting and respecting your privacy. This Privacy Policy will help you understand the personal data that we collect from you as a user or as a customer of our Sites, Incident Wall or Mobile App (collectively, the “Services”), what we use the data for and the choices you have regarding our use and collection of personal information.

We collect personal data from you as a user or as a customer of our Services in two ways: (i) information you give us: we collect any information you provide in relation to the Services; and (ii) automatic information: we automatically collect certain types of information when you interact with the Services.

By using our Services, you are accepting and consenting to the practices described in this Privacy Policy.

Personal Information We Collect.

The Company collects the following personal data about you:

Contact and account information. The personal details provided when users sign up to our Services. This includes user’s e-mail address, telephone number and password.

Information about your use of the Services. The information provided when users use the Services. This includes your location; the content you create, including comments, photographs and videos that you upload or broadcast on the Mobile App (“User Content”); and information about when User Content has been uploaded and/or read, and the participants of the communication; and user opt-in choices, configuration settings and communication preferences.

Technical information. If you use our Services, we may collect technical information from your device, which we describe in more detail in the “Cookies” section of this Privacy Policy, including your IP Address, browsing history or interaction logs (including User Content you have viewed), mobile carrier, time zone setting and model of your mobile device; metadata that describes how, when, and by whom a piece of User Content was collected and how such User Content is formatted.

 

Other Information. We collect any other personal details you choose to provide to us when corresponding with us by phone or e-mail, participating in user/customer surveys or otherwise visiting and interacting within our Services.

How We Use Personal Data.

For our business transactions, including, to perform a contract with you, to respond to your inquiries and fulfill your requests, to send administrative information to you, such as information regarding the Services, to complete and fulfill any requests for service, to customize the content you see when you use the Services, and to provide you with related customer service. Such use is necessary for the performance of the Services between you and us.

To communicate with you. We may use any information you choose to submit in connection with technical support, customer service, our marketing initiatives, or user or customer surveys, provided that you give us your consent to being contacted in this way at the time you provide us with the personal data.

 

For security purposes, such as to protect our Company, our customers, or our Services.

For legitimate business interests, such as to address complaints you make, to administer our platforms, to better understand how users interact with our Services and to ensure that our Services are presented in the most effective manner on your computer/mobile device.

For internal business reasons, we may aggregate the data that we collect and use such data for our own internal business purposes, or the business purposes of our affiliated businesses, and/or anonymize and de-identify data that we collect and it with our current and prospective customers, business partners, agents and other third parties for commercial, statistical and market research purposes, for example to allow those parties to analyze patterns among groups of people, and conducting research on demographics, interests and behavior.

For consented reasons. We may use personal data for other purposes which you have consented to at the time of providing your data.

With Whom We Share Collected Information.

We often need to engage third party companies and individuals (such as payment processors, research companies and analytics and security providers) to help us operate and provide the Services. These third parties have only limited access to information about you, may use such information only to perform these tasks on our behalf, and are obligated to us not to disclose or use information about you for other purposes. We will not share information about you except in the following circumstances or as otherwise described in this Privacy Policy:

With affiliated companies. We may share your information or User Content, including but not limited to, information from cookies, log files, device identifiers, location data, and usage data, with businesses that are legally part of the same group of companies that the Company is part of, or that become part of that group (“Affiliates”). Affiliates may use this information to help provide, understand, and improve the Service (including by providing analytics) and Affiliates’ own services (including by providing you with better and more relevant experiences). But these Affiliates will honor the choices you make about who can see your information or User Content.

 

With Incident Wall users. We may share the following information or User Content with Incident Wall users: (i) information about you, such as your username and location; and (ii) your User Content. Notwithstanding, Incident Wall users will honor the choices you make about who can see your information or User Content.

 

Vendors and service providers. We may disclose information about you to vendors, suppliers and service providers we retain in connection with our business, such as website hosting, data hosting, data analysis, information technology and related infrastructure provision, customer service, email delivery, tax and financial advisers, legal advisers, accountants or auditing.

Merger or acquisition. We may disclose information collected about you to a third party who acquires any part of our business, whether such acquisition is by way of merger, consolidation, divestiture, spin-off, or purchase of all or a substantial portion of our assets.

Disclosure permitted by law. We may disclose information collected about you to law enforcement authorities, government or public agencies or officials, regulators, and/or to any other person or entity having appropriate legal authority or justification for receipt of your information, if required or permitted to do so by law or legal process, to respond to claims, or to protect our rights, interests, privacy, property or safety.

With your consent. We may disclose information collected about you for any other purposes disclosed to you at the time we collect the information or pursuant to your consent.

User Content Involving Other Individuals.

Privacy and video surveillance laws in your jurisdiction may apply to your use of our Services. You are solely responsible for ensuring that you comply with applicable law when you use our Services. Capturing, recording or sharing video or audio content that involves other people, or capturing other peoples’ facial feature information, may affect their privacy rights.

People can also use our Services to create and share User Content about you with the audience they choose or with the public. If you are uncomfortable with what others have shared about you on our Services, you can report the content in accordance with our terms of service.

Cookies & Other Web Technologies.

Cookies. Our Services may use persistent and temporary cookies and similar technologies (collectively, “cookies”). Cookies are small text files sent to your computer for record-keeping purposes and this information is stored in a file on your computer’s hard drive. A persistent cookie retains user preferences for a particular website allowing those preferences to be used in future browsing sessions and remains valid until its set expiry date (unless deleted by the user before the expiry date). A temporary cookie, on the other hand, will expire at the end of the user session, when the web browser is closed.

Information collected through the use of cookies includes user operating system data, unique device ID, app usage data, login information, browser type and version, time zone setting or browser plug-in types and versions, location data, content interaction information, referring/exit pages and URLs, device functionality and service metrics information, such as when a device is in use, application usage, connectivity data, and occurrences of technical errors.

We use cookies for several purposes, including: (i) to improve user experience, and (ii) to collect anonymous and aggregated statistical data about users’ visits or use of our Services. We use this data to analyze how our Services are used and to improve it.

Unless you set up your internet browser (e.g. Mozilla Firefox or Google Chrome) not to accept cookies, it will accept the use of them. You can always disable cookies in your browser’s preferences even if you have consented to the use of cookies in the past. You may also delete cookies stored on your computer at any given time. Please note that disabling cookies may negatively impact your experience with the Services and prevent you from logging in to our Services.

Google Analytics. We use Google Analytics to help us better understand how you use our Services, and to facilitate interest based advertising associated with users’ Google account and other devices used by them. The information generated by the Google Analytics cookie about users of our Services are transmitted to and stored by Google. Information Security.

We take reasonable steps to protect the information you provide us from loss, misuse and unauthorized access, disclosure, alteration and destruction. We have implemented appropriate physical, electronic and administrative procedures to help safeguard and secure your information from loss, misuse, unauthorized access or disclosure, alteration or destruction.

Where we have given you (or where you have chosen) a password or log-in which enables you to access certain restricted parts of our Services, you are responsible for doing everything you reasonably can to keep these details secret. You must not share your password or log-in details with anyone else.

Because no security system is 100% secure, we cannot ensure the security of all information you provide to us via the Services.

Children.

The Services are not directed to children under 13. We do not knowingly collect personal information from children under 13. If you become aware that a child has provided us with personal information without parental consent, please contact us. If we become aware that a child under 13 has provided us with personal information without parental consent, we take steps to remove such information and terminate the child’s account.

California Residents.

We do not disclose your personal information to third parties for the purpose of directly marketing their goods or services to you unless you first agree to such disclosure. If you have any questions regarding this policy, or would like to change your preferences, you may contact us.

Once a calendar year, you may be entitled to obtain information about personal information that we shared, if any, with other businesses for their own direct marketing uses. If applicable, this information would include the categories of customer information, as well as the names and addresses of those businesses with which we shared customer information for the immediately prior calendar year. Users of the Services who are California residents and are under 18 years of age may remove User Content they posted by following the instructions provided in Mobile App. Please note that your request does not ensure complete or comprehensive removal of the material. For example, materials that you have posted may be republished or reposted by another user or third party.

EU Residents.

​

The Company agrees to limit the use of your data to fulfill the purpose for which it was collected. In addition, we agree to collect only data that is adequate, relevant, and not excessive for its purpose. In addition, if you are an EU resident, you have the right to:

  • ask whether we hold and process personal data about you;

  • receive a description of any personal data that we hold about you. This includes a description of the purposes for which we hold your data. It also includes which third-party business partners, or types of partners, we may share your information with;

  • receive a copy of any personal data we have stored about you;

  • ask that we correct or delete personal data about you that may be incomplete, inaccurate or excessive;

  • object to our use of your data at any time (unless our use is required by applicable law);

  • opt out, without charge and on request, to using your information for direct marketing; and

  • lodge a complaint with your local Data Protection Authority.

In the event of the death of a user, please contact us. We will usually conduct our communication via email; should we require any other information, we will contact you at the email address you have provided in your request.

We may revise this Privacy Policy from time to time. The most current version of the Privacy Policy will govern our collection, use, and disclosure of information about you. If we make material changes to this Privacy Policy, we will notify you by email or by posting a notice on the Services prior to the effective date of the changes. By continuing to access or use the Services after those changes become effective, you acknowledge the revised Privacy Policy.
